IMPORTANT INFORMATION — Please Read
The Compensation Data survey, referred to as “Application,” is protected by copyright laws. Subscribers to the Application must agree with the terms and conditions set forth in the following License Agreement (“Agreement”). The Application includes the survey questionnaire, the survey database and the vehicle/program used to access the database. Do not use the Application (which term includes the product documentation) until You have carefully read this Agreement. Logging into the Application indicates You have read, understand and accept this Agreement. If You do not accept this Agreement, do NOT login to the Application and contact Compdata Surveys (“CS”) within 30 days.

As used in this Agreement, the terms “You,” “Your,” “User” or “Licensee” are synonymous, and refer to a user or registered user, as the case may be, of the Application.  A “registered user” is a person who receives the web link to the Application directly from Compdata Surveys. In consideration of this Agreement, CS and Licensee agree as follows:

License This application contains examined, statistical compensation data (“Data”). You are granted one personal, non-exclusive license to the Application and any final edition thereof for one User.  This limited license allows the User to cite Data in documents created by the User during the course of business for internal use only.

Restrictions – Because the Application is protected by copyright laws, it is illegal to make additional copies or otherwise duplicate or permit the duplication of the Application by any other means (including electronic transmission) or to share Your username and password with another person. No part of the Application, including the text, data, graphics, and design may be reproduced or transmitted in any form, by any means without the prior written permission of CS. You may not distribute, modify, adapt, translate, transmit, rent, loan, resell, sublicense, resell for profit, create derivative works based upon or network the Application or any part thereof, or in any way create a misrepresentation or confusion among users with respect to the Data or the Application. The Application also contains CS’s trade secrets, and You may not decompile or otherwise reverse engineer the Application. The User is not authorized to assign or transfer this agreement without the prior written consent of CS.

Rights The examined Data in this Application is confidential and proprietary information of CS. The Agreement does not surrender any proprietary or other ownership of the Data to the User.  The User acknowledges CS owns the Data including all copyrights, patents, trade secrets and other proprietary rights herein.

Disclaimer Data provided by CS is for informational purposes only. Except as expressly provided above, this Application and the Services are provided “as-is” and, to the maximum extent permitted by applicable law, CS and its suppliers disclaim all warranties, express or implied, regarding the Application or Services and related materials, including their fitness for a particular purpose, their quality, their merchantability, or their non-infringement. CS does not warrant that the Application or Services are free from bugs, interruption, errors, or other program limitations.

CS will not be held liable in any event to the User or other party for any loss or damages of any kind, including damages for lost data or economic loss, even in the event CS has been notified of the possibility of such loss.

All warranties or guarantees given or made by CS with respect to the Application or Services (1) are for the benefit of the original Licensee of the Application only and are not transferable, and (2) shall be null and void if Licensee breaches any terms or conditions of this Agreement.  CS is not responsible for the performance of services or products offered by third parties in connection with the marketing and distribution of the Application.

Term The User will have access to Data for three years following the official release date of the survey results. CS reserves the right to terminate this Agreement in whole or in part upon written notice to the User if the User breaches any of the terms of this Agreement.  In addition, at CS’s sole discretion, if CS believes the Data is being used for a purpose not approved by CS, that CS’s rights are being infringed upon, or the User is in violation of this Agreement, it may immediately terminate this Agreement.  The Agreement shall be governed by the laws of the state of Kansas.

Limited Warranty
If the Application is defective, contact CS within 30 days, and a new version will be sent to You.
